Terms & Conditions

These terms govern the use of our website and the delivery of consulting services by Awan Method. Please take the time to read them carefully before engaging with our services.

1. Definitions

In these Terms and Conditions, the following terms carry the meanings set out below:

  • "Awan Method," "we," "us," "our" — refers to Awan Method, a business consulting firm operating from Level 30, Menara IMC, Jalan Sultan Ismail, 50250 Kuala Lumpur, Malaysia.
  • "Client," "you," "your" — refers to any individual or organisation accessing our website or engaging our consulting services.
  • "Services" — refers to consulting engagements offered by Awan Method, including Aviation Industry Advisory, Travel Industry Consultation, and Aerospace Services Strategy.
  • "Engagement" — a specific consulting project agreed in writing between Awan Method and a client.
  • "Deliverables" — reports, recommendations, analyses, or other outputs produced as part of an Engagement.
  • "Agreement" — these Terms and Conditions together with any written engagement letter or proposal.
  • "Website" — the site accessible at awanmeth.biz.

2. Acceptance of Terms

By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

You represent that you are at least 18 years of age and have the authority to enter into this Agreement on behalf of yourself or the organisation you represent.

These Terms apply in addition to any specific terms set out in an engagement letter or proposal issued by Awan Method.

3. Service Description

Awan Method provides business consulting advisory services to Malaysian organisations operating within the aviation, travel, and aerospace industries. Our current service offerings include:

  • Aviation Industry Advisory

    Eight to eleven week engagement. MYR 2,640. For established aviation-related enterprises.

  • Travel Industry Consultation

    Seven to nine week engagement. MYR 1,720. For established travel businesses navigating industry change.

  • Aerospace Services Strategy

    Eight to ten week engagement. MYR 510. For established aerospace services firms and MRO operators.

Service availability and scope are subject to discussion and agreement prior to commencement of any Engagement.

4. Client Responsibilities

To enable effective consulting engagement, clients agree to:

  • Provide timely access to information and personnel reasonably required for the Engagement
  • Engage with review processes and provide feedback within agreed timeframes
  • Ensure that information provided to Awan Method is accurate and complete to the best of your knowledge
  • Use the website and any Deliverables only for lawful purposes
  • Refrain from engaging in conduct that could disrupt or interfere with our services or systems
  • Maintain appropriate internal authorisation before commissioning an Engagement

5. Intellectual Property

All intellectual property rights in our website content, methodology, frameworks, and general knowledge materials remain the property of Awan Method.

Upon full payment of agreed fees, we grant the client a non-exclusive, non-transferable licence to use Deliverables produced for that specific Engagement for internal business purposes.

  • Deliverables may not be resold, sublicensed, or shared with third parties without prior written consent
  • Our underlying methodologies, frameworks, and general advisory approaches remain our intellectual property
  • Client-provided data and information remains the client's property

6. Payment Terms

Fees for consulting Engagements are denominated in Malaysian Ringgit (MYR) and are set out in the relevant engagement proposal.

  • A deposit of 50% of the agreed fee is payable prior to commencement of work
  • The remaining balance is due within 14 days of delivery of the final report or Deliverables
  • Payments may be made via bank transfer to account details provided in the engagement letter
  • Late payments may be subject to interest at a rate consistent with Malaysian law
  • Fees are non-refundable once an Engagement has commenced, unless Awan Method is unable to deliver the agreed scope

If you have questions about fee arrangements, please discuss these before signing an engagement letter.

7. Service Delivery Terms

We are committed to conducting Engagements with professional care and within agreed timeframes. The following terms apply:

  • Engagement durations are indicative; final timelines are agreed in writing before commencement
  • Changes to the agreed scope require a written variation agreed by both parties
  • Delays caused by the client's failure to provide required information or access may affect timelines without adjusting fee obligations
  • Deliverables are prepared on the basis of information available at the time of the Engagement
  • We may engage appropriately vetted subcontractors where necessary, subject to the same confidentiality obligations

8. Disclaimers

Our website and Deliverables are provided in good faith and with professional care. However:

  • Consulting observations and recommendations reflect professional judgement based on available information and are not representations of outcome
  • No specific commercial result is warranted from the engagement or adoption of our recommendations
  • Website content is for general informational purposes and does not constitute legal, financial, or regulatory advice
  • We are not responsible for decisions made by clients on the basis of our Deliverables

9. Limitation of Liability

To the extent permitted by Malaysian law:

  • Our total liability in connection with any Engagement shall not exceed the fees paid for that specific Engagement
  • We are not liable for indirect, consequential, or special losses, including loss of profit or business opportunity
  • We are not liable for matters outside our reasonable control, including industry changes, regulatory shifts, or force majeure events

10. Confidentiality

Both parties agree to maintain the confidentiality of commercially sensitive information shared during an Engagement. This includes:

  • Client operational and financial information shared to support the Engagement
  • Awan Method's proprietary methodologies and frameworks
  • Engagement scope, findings, and Deliverables

Confidentiality obligations survive termination of any Engagement for a period of three years, unless agreed otherwise in writing.

11. Indemnification

You agree to indemnify and hold harmless Awan Method, its principals, and associates from claims, losses, or expenses arising from your breach of these Terms, misuse of Deliverables, or provision of inaccurate information material to an Engagement.

12. Termination

Either party may terminate an Engagement by providing 14 days' written notice. In such cases:

  • Fees for work completed to the date of termination remain payable
  • Deliverables produced to date will be made available to the client
  • Awan Method reserves the right to terminate immediately where a client materially breaches these Terms

Sections 5, 9, 10, and 11 survive termination.

13. Dispute Resolution

We prefer to resolve any disagreements through direct, good-faith discussion. If a dispute cannot be resolved informally within 30 days:

  • The parties may agree to refer the matter to a mutually agreed mediator
  • If mediation fails, disputes will be subject to the jurisdiction of the Courts of Malaysia

These Terms are governed by the laws of Malaysia.

14. General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, constitute the entire agreement between the parties.
  • Severability: If any provision is found invalid, the remaining provisions continue in effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without prior written consent.
  • Notices: Formal notices should be sent to [email protected] or the registered business address.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page with a revised effective date. Continued use of our website or services following such an update constitutes acceptance of the revised Terms. Material changes to Engagement-specific terms will be communicated in writing.
